These terms are between you (the customer, or the organisation you sign up on behalf of) and Sorted Design Studio CC, trading as RSVP Sorted, registration number 2007/244764/23, VAT number 4690231693, of 135 Main Road, Green Point, Cape Town, South Africa ("RSVP Sorted", "we", "us"). By creating an account or using RSVP Sorted you agree to these terms.
1. What RSVP Sorted is
RSVP Sorted is an online platform for managing invitations, RSVPs, guest lists, check-in and event feedback. It is provided as software as a service: you sign up, use the platform through your browser, and pay for the plan or event size you use.
2. Your account and your organisation
You are responsible for the accuracy of the information you give us, for keeping your login details safe, and for what happens under your account, including actions by team members you invite. Team logins for the same organisation can be added under Billing.
3. Plans, events and guest allowances
RSVP Sorted offers monthly and yearly subscription plans, once-off event packages, a done-for-you service where we run the event on your behalf, and a free trial. Guest allowances count invited guests only; guests who bring a plus-one are not counted twice against your allowance. Guests beyond a plan's allowance are billed as extra guests at R5 per guest, plus VAT where VAT applies.
The free trial is one event, up to 50 invited guests, with no card required, and is available once per organisation.
4. Fees, billing and VAT
RSVP Sorted is a VAT-registered vendor. Customers billed in South Africa pay VAT at 15%, and rand prices on our pricing page include it. Outside South Africa we sell to businesses only, and they pay no VAT, as a zero-rated supply of services to a non-resident. The billing country you give us decides which applies. Payment is taken in South African rand through PayFast. Where prices are shown in another currency on our pricing page, that amount is an indication only; you are charged in rand.
Subscription plans are billed in advance and renew automatically, monthly or yearly, until you cancel. You can cancel at any time from Billing in your account. A cancelled plan stays active until the end of the period you already paid for, after which your account becomes read-only: you can no longer add guests, send invitations or run new campaigns, but nothing is deleted immediately.
Once-off events and extra guests are charged once, for the guest limit or extra guests you buy. Done-for-you events are quoted and charged per event.

5. Acceptable use
You may only invite people you have a relationship with, or another lawful basis to contact, and you may not use RSVP Sorted to send spam or unsolicited bulk email, or to send unlawful, harassing, defamatory or misleading content. We may suspend or terminate an account that we reasonably believe is being used to send spam, breaches this section, or has fees outstanding.
6. Guest data is your responsibility
When you upload a guest list or send invitations, you are the party responsible for that personal data under data protection law (see our privacy policy for how this works). You confirm that you have a lawful basis to hold and contact those guests, and that you are entitled to upload their details to RSVP Sorted.
7. Availability
We make reasonable efforts to keep RSVP Sorted available and working correctly, including on the day of an event, but we do not guarantee uninterrupted availability and give no uptime guarantee.
8. Liability
To the extent permitted by law, our total liability to you for any claim arising from these terms or your use of RSVP Sorted is limited to the fees you paid us in the 12 months before the claim arose. We are not liable for indirect or consequential loss, including loss of profit, loss of guests, or loss of data beyond our obligations under our privacy policy.
9. Suspension and termination
We may suspend or terminate your account for non-payment, for a breach of these terms, or for abuse of the platform. You may close your account at any time. On closing, you can export your data before it is deleted according to our retention rules (see our privacy policy).
10. Changes to these terms
We may update these terms from time to time. Where a change is material, we will give notice, for example by email or a notice in the app, before it takes effect.
11. Governing law
These terms are governed by the law of South Africa, and the South African courts have jurisdiction over any dispute.
12. Severability
If any part of these terms is found unenforceable, the rest continues to apply.
